☆ This page serves as general guidelines for commissioning XernDrawz which includes payment information, customer rights, time of delivery, usage and more. By requesting a commission, you agree to the listed terms and conditions.
☆ Refusal to follow these terms will result in subsequent blacklisting from future commissions.1. Payment
-I collect payment through Venmo, though if a different option is requested I can discuss different choices. I will not use PayPal.
- All of my prices are in USD and the customer is expected to pay the amount in USD. If you live out of the United States, I trust you to scale your currency to USD.
- I will collect 25% of the initial payment upfront. This is to ensure my safety and delivery of my rightful payment for the commission. The customer has a 3 day grace period to send this payment after details have been decided upon.
- Chargebacks and attempted fraudulent behavior will automatically result in being blacklisted from contacting/commissioning me again, and such charges will be disputed with my bank.- I incur extra fines for backgrounds. This includes backgrounds depicting scenes and elaborate designs. It does not include flat color, picture/photo, or simple abstract backgrounds.
- I incur extra fines for very detailed characters. This is up to my own discretion and what I believe would take me more time. “Detailed” typically means characters with very ornate patterns, several small details, incredibly complex clothing and design elements.
- I incur extra fines for adding another character. However, this is a fixed rate - the price doesn’t increase the more characters there are (i.e, if the fine to add 1 character is $5, the fine to add 3 is $15.)2. Restrictions
The following section details what I will not draw under any circumstance. Please respect my boundaries and do not request content that is specified to be restricted.1. Content which is hateful towards a group of individuals, ex. LGBTQ+ persons, racial groups, religious groups and institutions, countries and disabled persons.
This, of course, includes symbols and depictions representing hateful behavior and/or groups. (ex. Swastikas/Nazi symbols, defacing flags of LGBTQ+ minorities and/or other marginalized groups, requesting racist depictions of individuals, etc.)2. Content meant to depict hate towards a specific real life individual, which may include representations of violence against said person and/or defacing the individual in some regard.3. Extreme depictions of violence which include realistic gore, show of organs, extreme fatalities, severe self harm/suicide and detailed depictions of brutal death.
Content such as blood, knives and weapons, needles, characters with self harm scars, and minor violence are acceptable. If you are unsure, feel free to ask.4. Content considered Not Safe For Work or sexually suggestive, ex. depictions of genitalia, sexual acts, sexualized actions or outfits, or content with the intent to arouse.
What I consider suggestive is ultimately my own opinion, and communication is important. Please ask me if you think something falls under this category.
Depictions of romance and romantic gestures are acceptable.5. Content which depicts sexual fetishes or is meant to be used within the context of sexual fetishes.
If I suspect that such content is being requested, I have the right to decline my services.
If, at any point, the commissioned art is used in the context of a sexual fetish, it will result in being blacklisted from future commissions.6. Content which depicts illegal or immoral actions such as pedophilia, incest, assault, etc.
Depictions of drug usage, alcohol usage and smoking are acceptable.I have very little experience drawing mecha, anthro, animal, and exaggerated creature/character designs. You're allowed to request these things, but I may decline if I do not feel confident I can deliver a quality product.3. Usage
These are the terms of how the commissioned artwork may be used.1. Artwork may be used as icons, banners, for personal use on social media and other online websites.
Crediting me is not required, but highly appreciated. You are not permitted to say my artwork is your own or that you made it.2. Artwork that is commissioned can be edited by the customer in the future if so desired. However, the artwork cannot be edited to depict any of the actions/content discussed in Section 2 - Restrictions.3. My artwork cannot be used with the expressed purpose of profiting, reselling, or other commercial uses (which includes inclusion in a for-profit project).
If you would like to use my artwork for commercial uses, i.e usage in a game or other monetized project, please send me thorough details of what the artwork will be used for. You may be charged with an additional fee for this specific usage.
Copyrighting my work or attempting to sell my art claiming it as your own is not permitted under any context.4. You are allowed to print my artwork or turn it into physical media, i.e posters, stickers, keychains etc.. for personal use.
As implied in the previous sections, you are not allowed to resell the physical work or make commercial profit.5. You are not allowed to use my artwork to train AI models for any purpose whatsoever.4. Customer Rights
As a commissioner, you have many rights of which you are entitled to.- Please feel free to send references, inspiration, specific details, etc.. It is not a burden, it is very helpful!- I will send you multiple progress photos of my process. You may change details at any point during the sketch/coloring phases, as many times as necessary, free of any charge.- If the piece has been finished and a change is requested, I will comply if the change is minor. Depending on the circumstance, it may not be possible for me to change it, or I will ask for a small additional fee.- I am a very busy person, and I may not get around to commissions immediately. Please feel free to message me about progress or to remind me. This is especially encouraged if you have not heard from me for more than 2 weeks.- If the commission has not been completed in 6 months, I will automatically refund the initial 25% charge. This will have no negative effect on your ability to commission me in the future if you so desire.- If I have not yet started a commission, you are free to request a refund of the initial 25% charge after 2 weeks.☆ Thank you for your interest in commissioning me as well as your continued support!
